Remember the House Republican’s Lawsuit Against Obamacare? An Important Victory in the Case.
The Republican-led House of Representatives won a small but important victory in its fight against the Affordable Care Act Wednesday when a Washington, D.C. federal judge ruled that their lawsuit, filed way back in November of last year, has standing.
The lawsuit argues that federal agencies lack the constitutional authority to draw billions of dollars from existing appropriations to fund the Affordable Care Act’s provision to reimburse insurers for low-income people’s health insurance.
In the lawsuit, the House argues:
“Congress has not, and never has, appropriated any funds (whether through temporary appropriations or permanent appropriations) to make any … payments to insurers.”
